Systemic errors in the justice system refer to recurring failures that indicate deeper problems with institutional ethics and procedures. When bail is granted and then contested through appeals, it may indicate systemic issues rather than individual failures. The proper approach is to identify and address the root causes of these errors, such as questioning those who granted bail and those who transferred courts, rather than simply appealing the outcome. This highlights the importance of institutional accountability and the need for systemic reforms to ensure justice for all citizens.

LIVE: Twisha Sharma's Husband Samarth In Police Custody | Justice For Twisha or More Delays?インデックス作成:
LIVE: Twisha Sharma's Husband Samarth In Police Custody | Justice For Twisha or More Delays? The post-mortem report of 31-year-old Twisha Sharma, the daughter-in-law of a retired judge who was found dead at her marital home in Bhopal earlier this month, has revealed the presence of two distinct hanging marks on her neck, even as police maintained that the case was one of suicide. According to findings from the autopsy report, Twisha’s neck bore two parallel marks caused by pressure from the hanging material used in the incident. The marks, each around 2 cm wide, were described as reddish-patterned abrasions running upward across both sides of the neck and located above the thyroid region. Doctors also noted congestion and blood infiltration in the neck tissues. #twishasharma #twishasharmadeath #dowrydeath #patriarchy #twisha #samarth #cbiprobe #preetichoudhry #tothepoint #breakingnews #indiatodaylive #crimeupdate #watchlive #latestnews #indiatodaylivestream Subscribe to India Today for NEW VIDEOS EVERY DAY and make sure to enable Push Notifications so you'll never miss a new video. so as to allow Samur to surrender in Jabalpur itself.
All right let's I'll come back to you Anisha just one minute the reason I'm interrupting you is I want to cut across to Mr. Navnidhi Sharma he is Tisha's father Sharma Shukria thank you joining us right now taking the time out sir developments Honorable High Court only can surrender in front of IO or trial court.
What is this? But lifethreatening situation against the lawrence.
Look out notice.
He should be in the custody high court.
Mr. Sharma, why do you think what is the reason behind it? Why is he doing this?
>> This is the tactics now. This is the tactics to avoid the custody.
>> So you're saying this is all planned.
This is to avoid custody.
>> This is all planned. This is all influence which is playing which is playing under under your eyes. Your media has been threatened. Your media has been threatened. My advocate has been threatened and beaten.
>> He a man of repute. He's a man of repute. for 35 years practicing he never seen this kind of incidents you see this this is happening this is a black day >> and Mr. So Sharma your appeal is that he should not be allowed to surrender in Jabalpur. That is your appeal.
>> This is a total failure of administration. Total failure. This is showing the clear influence. This is showing this is very very difficult. We are in a very difficult position. Madam I'll join you because I am in a hurry. I am in on a way because >> I want to ask you one quick question sir before I let you go. Just one quick question. The >> second postmortem has been allowed by the court. Are you >> has been allowed has been allowed and uh the panel will be finalized by the as director or with the director of the court uh high court. So we are waiting for that. Uh we are uh looking for the development. I'll come back to you later madam.
>> Thank you Mr. Sharma for taking the time out and joining us. All right. So there you have it. Navnidhi Sharma Tuisha's father extremely angry livid. He say as per Tuisha's family these are all ways of trying to subvert justice for Tuisha where an attempt be made that he surrenders in Jabalpur therefore he will not be arrested and I want to cut across to my colleague Anisha Matur who's standing by giving us the latest uh details um Anisha in terms of the legal developments one really does have to understand the apprehensions and the contention of Tuisha's father where he says this is all pressure tactics which are playing out. This is influence that we can see where you have Sam who is looking to surrender in Jabalpur when he needs to surrender in front of the investigating officer and taken under arrest. Well, Priy, let me clarify a little bit here. Tamat did not have to surrender before the investigation officer. The high court very clearly said he can surrender before the court or before the investigation officer.
which is why we've seen this last couple of hours of footballing really because Sam chose to appear before a court. The judge was not there. The magistrate on duty was simply not there in the court.
Then followed this hour couple of hours of him going from courtroom to courtroom while we were all watching and questioning what on earth is really going on. At the same time, Priti, the question really goes to the police because this as and we've been discussing this. This is a cognisible offense. This means that if the ACP of the area, the SHO finds out that a person who is accused of this heinous crime is within their jurisdiction that they should then direct their officials to go and arrest him. The only place that Sam could not have been arrested was if he was actively inside the courtroom which he was not. He was roaming around in the court corridors.
So clearly he could have been arrested.
Anish you stay with me and continue to give us your legal perspective. I am quickly joined by Ashish Sharmaisha's cousin. I believe he needs to leave very quickly. Understandably needs to go and meet a lawyer. Um Ashish with the way these developments are taking place.
>> Thank you for appreciating.
>> No I just want to come to you Ashish.
Thank you for taking the time out and joining us. The current developments, we spoke to Tuisha's father, your uncle, and he says this is all an attempt to subvert justice and this is influence playing out.
>> My question is that who is who is more powerful? Who has the authority? Madhya Pradesh police does the constitution of India rules this state or they have their own These are the questions that must be asked to the authorities here person along with the paraphernalia.
>> The the law itself is subjudice to their house to the people who are connected to them. I'm telling you this person presented himself at the Javar court because he's having adequate degree of uh uh collusion and protection at that court. The senior officers of this court must be inquired. This entire judiciary in this state is under question now.
>> Ashish, what you want right now or what is the appeal of your family which is including we spoke to Tuisha's father that he should have been taken under arrest immediately. Is that what was is uh what your appeal is?
>> Absolutely. Yes. All those who have colluded with this family, not only the police but the senior very senior judicial officers, the constitutional position holders the names of which have been identified. And if you further investigate whom did they call? They must have called people at in in this in this court of Jabalur on the on from that day since that sister died to this day. They all are colluding. They all are uh are are party to this crime. So not only this summer would must be arrested. The police must be questioned that do you require in this year of 2026 to uh to announce uh rewards. That means you are not needed and this has been prove it proven when you are not catching him. You are just announcing reward. Somebody would be bringing this person to you and none of there was hardly any attempt by the police. This is this is a shame on the the police of Madhya Pradesh.
This person does not deserve to be uh to be to be given such kind of a leeway.
I'm not able to understand what on earth is compelling the authorities in Madhya Pradesh to stay subjudice to this family. As I said, what kind of lies and what kind of favors have you conducted among yourself? What what is the fear that that is allowing you to allowing this uh the this family to perpet perpetrate whatever that they are doing?
This is absolute case of favorism. This is absolute case of I scratch my back your back and you scratch my back back.
This is all that is what is happening.
You can see that this these are scenes.
>> What you're saying is as you >> despite of the media pressure, despite of the civil society pressure, uh he continues with his family in collusion with what you're saying with the lower courts and trying to manipulate the system. That's what of this retired judge and you will get to know whom she's colluding with, whom she is calling for help. If this country does not have those mechanisms to understand to identify the people who are party to it then we are a absolute failure. This country will not be able to provide justice to all and alike.
>> The case in any case Ashish has now been transferred to the CBI. The CBI is investigating the case. Do you have faith that it will you know with time justice will be delivered? Is there faith in the system?
authority which uh investigation agency which most of us believe and uh I mean the common people believe that they they they would be sharp and they would be impartial and I I and this is this is a small glimmer of hope in this entire dark uh that the last 10 days that we have we are we are where we have felt harassment and horror that the scenes that you are seeing today this is what was happening in the court that Bhopal when justice Giribbala Singh was granted bail but these these captures were not made. This is exact exactly the scene that that that the family witnessed the horror that the family witnessed in this the court of Obal. So CBI is is a great welcome. We are thankful to the honorable chief minister of Madhya Pradesh for for demanding the center for the CBI investigation. But important is that how early CBI gets into activation and and the influence that is continuously being uh allowed and that that that need to be shielded.
Ashish, there was an appeal by your family that a second postmortem of Tuisha be conducted. The courts have now allowed that.
Is there a sense of peace because at least with what you your family wanted for a second uh postmortem that has now been allowed.
>> Absolutely true ma'am. This second postmortem was uh demanded so that uh the suspicions and the uh circumstances that that were absolutely opposite to what that was uh told uh through the first PM report and and and and uh through the police by to us. But they were continuously denying this PM2.
Fortunately after lot of struggle first with the police then with the uh sessions court at Bopal and then finally to the high court. This uh decision has been made. We are there is really a sense of peace not only for the fact that the evidences can now be collected from the body of uh deceased Tusha. But at the same time it has given us a hope that now sooner or later we would be able to cremate her with with all due respects to her mortal remains. So that's that that was a the question that simply basically I would say a private uh you know uh uh matter and a feeling that can not cannot be expressed to the media. But this is something that is going on in the minds of not only the people family which is staying here but back home who expected us to bring her there and then uh our you know the the the the cremation and the subsequent rituals that happen in in a Hindu family. So it's it's a great great pain that you ask the mother how she's feeling. She's consistently on drips and was taken to hospital day before discharge today morning and just because of fact that we are not able to cremate her and we are not able to cremate because the system is harassing us. This system has put us to our knees.
>> My heart goes out to you. I'll ask you one one quick question Ashish because I know you need to go you need to meet your lawyers and that one question that I want to ask you is that at least right now you said the systems brought you to the knees and we're very sorry that your family has to go through what they're going through uh but now you have uh uh the Madhya Pradesh police that has moved high court seeking cancellation of uh anticipatory bail for Girabala Singh are you in that sense do you have hope that even that bail will be cancelled or do you think there's further scope of trying to manipulate the system.
>> I would uh uh on the outward I would say yes these are positive indications but from the bottom of my heart I would express that I do not see as hope.
You know why? Because it indicates systemic errors. It indicates systemic loss of ethics. Instead of going there to get the the bail canled, I would say that first go to people who actually granted bail to her. Go to the people who were just transferring the courts.
Ask the family how many courts did they were required to go from one one uh room by the people who were standing over there.
Those questions those people should be questioned.
you it's it's import it's not uh uh just correcting something by going for you know an appeal that is one thing but the uh just identify the root >> I hear you Ashish I do hear you >> please act on the that no Ash I hear you is there you know before you you leave is there a message is there something that you want is there an appeal Definitely.
Please fast track the PM2 so that the cremation can be conducted at the earliest because today we have many who are with with the father because uh I and I'm I I'm sorry if I hurt somebody because public memories so appeal is that so that we can cremate her. Number two, we have full faith in the CBI. Please fast track it. Please immediately get the CBI activated so that whatever Gundardi that you are seeing in this Japalur court and where the even forget about my family the the the reporters are being uh threatened the reporters are being beaten chairs being thrown on them. This is unprecedented in in in in India's history. This cannot go that way. Who are they? Are are they the ones who are running this country?
They have made a mockery when the entire media is with us. Still this this this thank you for laying bare your emotions.
Um and you know it's not even but but maybe your voice will be heard and I really hope it is and that is what our endeavor will be to make it be heard.
Thank you. I want to cut across uh to Tarita Shankar Indra University owner Tisha's professor Mihas Su advocate supreme court scholar of women's right.
I also have uh with me I believe Anisha continues to be with me. Um I want to come to you Mihara with what is playing out right now in Jabalpur. uh the family is very clear that this is subversion of justice. This is collusion at the lower courts and uh manipulating the system of people as powerful as this family.
>> Yeah.
Um look why he's approached Jabalpur, there's obviously some kind of strategy there.
Some of it may be visible, some of it may be not known to the public. I don't know what their connections in Jabalpur are. But the fact is that the police should not be and the you know the CB the cases with the CBI I don't know why they've not gotten you know activated u uh in this case yet um or no none of these institutions are toothless you know wherever he has chosen to surrender it is not as if there's no power to do anything. So you know why why is it taking so long um you know to to get basic procedures in place? uh why is it taking so long uh for you know even even the the question of a a second autopsy it's taken so long um you know for the court to finally agree to it and I completely I mean more power to Tisha's family that is fighting this case and tooth and nail and having to fight it on multiple fronts because it is very clear that uh you know Twisha's in-laws they're taking this the mother-in-law is taking this battle to the media there are almost daily press conferences.
Um and and you know there clearly this the battle is trying to be is sought to be fought on this front as well and that's dragging Twisha's family into onto this front and having to fight battles on multiple fronts. Uh that is completely unfair. They're a family that's not been allowed to grieve. their request for a second postmortem uh you know was was uh sought to be painted as an uncaring family unwilling to even perform their daughter's last rights. Everything they say, everything she has said has been twisted. And frankly, I don't even know why uh these accused are continuing to speak to the media when frankly every press conference and every statement that seems to come from uh you know, Twisha's mother-in-law only makes her look worse.
You know m I want to ask you allow me to ask you one question because what most people are not understanding is and one can you know hear it in the frustration of the family every time they speak because if it is a case of dowry harassment if it is a case of domestic violence in terms of dowi then the onus lies on the accused which is the family what one doesn't understand Mihira is how is it that girbala saying the mother-in-law had got anticipatory bail because in all of this uh you know this is immediate arrest and I understand every time you speak to the father you speak to the brother because they they they just don't can't seem to uh you know uh put it in words on how frustrated they are usually the family should have been arrested immediately >> shocking you know anticipatory bail is denied where even when there is far less evidence than this and in this case there is so much in terms of you know the kind of conversations she had recorded conversations, text messages, etc. that she had with her friends and family. Um, you know, anticipatory bail is not given in cases with far less evidence. So, it is it is shocking that her anticipatory bail was denied. And the constant claim that you know we are being hounded and you know the idea that there is some persecution when in fact the law states that when a woman faces an unnatural death you know uh suffers an unnatural death within the first seven years of marriage it is presumed to be caused by dowry harassment and the onus is on the in-laws the husband and the in-laws. Um and in in this particular case there is specific allegations that were made in the in the leadup to this tragedy. Mhm.
>> Uh so anticipatory bail absolutely has to be cancelled and it is quite clear from we are seeing in the media I don't know how the police and the investigating authorities are you know sitting idle on this when we are seeing in the media you know her sister is and the at the hospital uh you know trying to allegedly influence the postmortem and uh you know all these things are going on and you know that she's uh she's a retired >> it's it's just implausible and it's suddenly now you have uh the Madhya Pradesh police that has woken up from its lumber and now are contesting uh and can for the cancellation of the anticipatory bail of Girib Bala Singh up they've woken up only because of media pressure.
>> Yeah, you're right. It is it is only media pressure. It's it's nothing else.
>> Everybody is only concerned with their public image.
>> True. I agree with that. Uh you know I just want to bring in Tarita Shanka. She was Thisha's professor. Tarita, how are you looking at all these developments that have taken place?
>> Hi Priti. It's actually been a very harrowing last 10 days from the time that we came to know something like that has happened and it was unbelievable absolutely unbelievable because the Twisha that we knew she was in our university from 2011 to 2014 doing her BBA she was one of the most sweetest bubbliest bold confident young girl I mean she was in her 20s early 20s 1920 and uh I mean she was very close to me at that time because uh I was like a mentor to her and because she got a won a lot of accolades for the university.
She used to always come and meet me. She was Miss Pune then she was she also won a couple of other contests. She used to always walk the ram for us. She won a lot of competitions and she used to do a lot of anchoring for us and she was really close to me at that time and suddenly I mean after that five six years we were in touch but I think postcoid we were not in touch and all I feel today I really feel unfortunate that something like that can happen to a girl like her. If it can happen to her, it can you can imagine to the girls who are not as bold and confident as us.
What will be there, you know, like in the world like I mean it is really >> I I I I don't want to address it and and give it legitimacy at all is here to surrender and they are moving an application before the chief judicial magistrate. I want to bring in my colleague Anisha for a larger understanding. Anisha earlier on when he wanted to surrender at the Jabalpur court uh protocol demanded that he go back to Bopal. Now it seems his lawyers uh are running are uh actually going to submit an application move an application before the chief judicial magistrate so as to allow Samur to surrender in Jabalpur itself.
All right let's I'll come back to you Anisha just one minute. The reason I'm interrupting you is I want to cut across to Mr. Navidhi Sharma he is Tuisha's father Sharma Gih Shukria thank you. You're joining us right now taking the time out sir.

They have made a mockery when the entire media is with us. Still this this this thank you for laying bare your emotions.
Um and you know it's not even but but maybe your voice will be heard and I really hope it is and that is what our endeavor will be to make it be heard.
Thank you. I want to cut across uh to Tarita Shankar Indra University owner Tuisha's professor Mihasud advocate supreme court scholar of women's right.
So, you know, why why is it taking so long um you know, to to get basic procedures in place? Uh why is it taking so long uh for you know, even even the the question of a a second autopsy, it's taken so long um you know, for the court to finally agree to it.
And I completely I mean more power to Tisha's family that is fighting this case and tooth and nail and having to fight it on multiple fronts because it is very clear that uh you know Twisha's in-laws they're taking this the mother-in-law is taking this battle to the media. There are almost daily press conferences um and and you know there clearly this the battle is trying to be is sought to be fought on this front as well and that's dragging Twisha's family into onto this front and having to fight battles on multiple fronts.
You know, mayor, I want to ask you, allow me to ask you one question because what most people are not understanding is, and one can, you know, hear it in the frustration of the family every time they speak because if it is a case of dowy, harassment, if it is a case of domestic violence in terms of dowry, then the onus lies on the accused, which is the family. What one doesn't understand Mihira is how is it that Girabala saying the mother-in-law had got anticipatory bail because in all of this uh you know this is immediate arrest and I understand every time you speak to the father you speak to the brother because they they they just don't can't seem to uh you know uh put it in words on how frustrated they are usually the family should have been arrested immediately >> shocking you know anticipatory bail is denied where even when there is far less evidence than this. And in this case there is so much in terms of you know the kind of conversations she had recorded conversations text messages etc that she had with her friends and family. Um you know anticipatory bail is not given in cases with far less evidence. So it is it is shocking that her anticipatory bill was denied and the constant claim that you know we are being hounded and you know the idea that there is some persecution when in fact the law states that when a woman faces an unnatural death you know uh suffers an unnatural death within the first seven years of marriage. It is presumed to be caused by dowry harassment and the onus is on the in-laws the husband and the in-laws. Um and in in this particular case there is specific allegations that were made in the in the leadup to this tragedy. Mhm.
>> Uh so anticipatory bail absolutely has to be cancelled and it is quite clear from we are seeing in the media I don't know how the police and the investigating authorities are you know sitting idle on this when we are seeing in the media you know her sister is and the at the hospital uh you know trying to allegedly influence the postmortem and uh you know all these things are going on and you know that she's uh she's a retired >> it's it's just implausible and it's suddenly now you have uh the Madhya Pradesh police that has woken up from its lumber and now are contesting uh and can for the cancellation of the anticipatory bail of Girib Bala Singh up they've woken up only because of media pressure >> yeah you're right it is it is only media pressure it's it's nothing else everybody is only concerned with their public image >> true I agree with that uh you know I just want to bring in Tarita Shanka she was Tisha's professor Tarita how are you looking at all these developments that have taken place >> hi Pri it's actually been a very harrowing last 10 days from the time that we came to know something like that has happened and it was unbelievable absolutely unbelievable because the Twisha that we knew she was in our university from 2011 to 2014 doing her BBA she was one of the most sweetest bubbliest bold confident young girl I mean she was in her 20s early 20s 1920 and uh I mean she was very close to me at that time because uh I was like a mentor to her and because she got won a lot of accolades for the university. She used to always come and meet me. She was Miss Pune. Then >> is here to surrender and they are moving an application before the chief judicial magistrate. I want to bring in my colleague Anisha for a larger understanding. Anisha earlier on when he wanted to surrender at the Jabalpur court uh protocol demanded that he go back to Bopal. Now it seems his lawyers uh are running are uh actually going to submit an application move an application before the chief judicial magistrate so as to allow Sam to surrender in Jabalpur itself.
All right let's I'll come back to you Anisha just one minute the reason I'm interrupting you is I want to cut across to Mr. Navnidhi Sharma he is Tuisha's father Sharma Gih Shukria thank you okay you're joining us right now taking the time out sir Honorable High Court only can surrender in front of IO or trial court.
What is this? But life threatening situation against the law.
Look out.
He should be in the custody honorable high court.
He is a man of repute. He's a man of repute. for 35 years practicing he never seen this kind of incidents you see this this is happening this is a black day >> and Mr. Mr. Sharma, your appeal is that he should not be allowed to surrender in Jabalpur. That is your appeal.
>> This is a total failure of administration. Total failure. This is showing the clear influence. This is showing this is very very difficult. We are in a very difficult position. Madam, I'll join you because I am in a hurry. I am in on a way because >> I want to ask you one quick question, sir, before I let you go. Just one quick question. The second postmortem has been allowed by the court. Are you >> has been allowed has been allowed and uh the panel will be finalized by the as director or with the director of the court uh high court. So we are waiting for that. Uh we are looking for the development. I'll come back to you later madam.
>> Thank you Mr. Sharma for taking the time out and joining us. All right. So there you have it. Uh Navnidhi Sharma Tuisha's father extremely angry livid. He say as per Tuisha's family these are all ways of trying to subwart justice for Tuisha where an attempt be made that he surrenders in Jabalpur therefore he will not be arrested and I want to cut across to my colleague Anisha Matur who's standing by giving us the latest uh details um Anisha in terms of the legal developments one really does have to understand the apprehensions and the contention of Tuisha's father where he says this is all pressure tactics which are playing out. This is influence that we can see where you have Samart who is looking to surrender in Jabalpur when he needs to surrender in front of the investigating officer and taken under arrest.
At the same time, Prii, the question really goes to the police because this as and we've been discussing this.
Anisha, can you stay with me and continue to give us your legal perspective? I am quickly joined by Ashish Sharma's cousin. I believe he needs to leave very quickly.
Understandably needs to go and meet a lawyer. Um Ashish with the way these developments are taking place.
>> Thank you for appreciating.
>> No, I just want to come to you Ashish.
Thank you for taking the time out and joining us. The current developments, we spoke to Tuisha's father, your uncle, and he says this is all an attempt to subvert justice and this is influence playing out.
>> My question is that who is who is more powerful? Who has the authority? Madhya Pradesh police does the constitution of India rules this state or they have their own These are the questions that must be asked to the authorities here >> person along with the paraphernalia >> the the law itself is subjudice to their house to the people who are connected to them. I'm telling you this person presented himself at the jabber court because he's having adequate degree of uh uh collusion and protection at that court.
They must have called people at in in this in this court of Japur on the on from that day since that sister died to this day.
This is this is a shame on the the police of Madha Pradesh.
What you're saying is despite >> despite of the media pressure, despite of the civil society pressure, uh he continues with his family in collusion with what you're saying with the lower courts and trying to manipulate the system. That's what of this retired judge and you will get to know whom she's colluding with, whom she is calling for help. If this country does not have those mechanisms to understand to identify the people who are party to it, then we are a absolute failure.
This country will not be a able to provide justice to all and alike.
>> The case in any case Ashish has now been transferred to the CBI. The CBI is investigating the case. Uh do you have faith that it will you know with time justice will be delivered. Is there faith in the system?
>> Authority which uh investigation agency which most of us believe and uh I mean the common people believe that they they they would be sharp and they would be impartial and I I and this is this is a small glimmer of hope in this entire dark uh the last 10 days that we have we are we are where we have felt harassment and horror. that the scenes that you are seeing today this is what was happening in the court at Bhopal when justice Giribbala Singh was granted bail but these these captures were not made this is exact exactly the scene that that that the family witnessed the horror that the family witness in this the court of so CBI is is a great wealth we are thankful to the honorable chief minister of Madhya Pradesh for for demanding the center for the CBI investigation but important is how early CBI gets into activation and and the influence that is continuously being allowed and that that that need to be shielded.
Ashish, there was an appeal by your family that a second postmortem of Tuisha be conducted. The courts have now allowed that.
Is there a sense of peace? because at least with what you your family wanted for a second uh postmortem that has now been allowed.
Absolutely true ma'am. This second postmortem was uh demanded so that uh the suspicions and the uh circumstances that that were absolutely opposite to what that was uh told uh through the first PM report and and and and uh through the police by to us but they were continuously denying this PM2.
Fortunately after lot of struggle first with the police then with the uh sessions court at Bopal and then finally at to the high court this uh decision has been made. We are there is really a sense of peace not only for the fact that the evidences can now be collected from the body of uh deceased Tusha but at the same time it has given us a hope that now sooner or later we would be able to cremate her with with all due respects to her mortal remains. So that's that that was a the the question that simply basically I would say a private uh you know uh uh uh matter and and a feeling that can not cannot be expressed to the media but this is something that is going on in the minds of not only the people family which is staying here but back home who expected us to bring her there and then uh our are you know the the the cremation and the subsequent rituals that happen in in a Hindu family.
I'll ask you one one quick question Ashish because I know you need to go. you need to meet your lawyers and that one question that I want to ask you is that at least right now you said the systems brought you to the knees and we're very sorry that your family has to go through what they're going through uh but now you have uh uh the Madhya Pradesh police that has moved high court seeking cancellation of uh anticipatory bail for Girabala Singh are you in that sense do you have hope that even that bail will be canled or do you think there's further scope of trying to manipulate the system >> I would uh uh on the outward I would say yes these are positive indications but from the bottom of my heart I would express that I do not see as hope you know why because it indicates systemic errors it indicates systemic loss of ethics instead of going there to get the the bail canled I would say that first go to people who actually granted bail to her go to the people who were just transferring the courts ask the family how many courts did they required to go from one one uh room by the people who were standing over there.
Those questions those people should be questioned.
You it's it's import uh just correcting something by going for you know an appeal that is one thing but the uh just identify the root.
I hear you Ashish. I do hear you.
>> Please act on the that >> No Ashish I hear you. Is there you know before you you leave is there a message?
Is there something that you want? Is there an appeal?
>> Definitely appeal.
Please fast track the PM2 so that the cremation can be conducted at the earliest.
Today we have many who are with the father because I and I'm I'm sorry if I hurt somebody because public memories.
So appeal is that so that we can cremate her. Number two, we have full faith in the CBI. Please fast track it. Please immediately get the CBI activated so that whatever Gundardi that you are seeing in this Jabalpur court and where the even forget about my family the the the reporters are being threatened, the reporters are being beaten, chairs being thrown on them.
Ask the family how many courts did they were required to go from one one uh by the people who were standing over there.
Those questions those people should be questioned.
You it's it's importing something by going for you know an appeal. That is one thing but the uh just identify the root.
>> I hear you Ashish. I do hear you.
>> Please act on the that.
>> No Ash I hear you. Is there you know before you you leave is there a message?
Is there something that you want? Is there an appeal?
>> Definitely appeal.
Please fast track the PM2 so that the cremation can be conducted at the earliest because today we have many who are with with the father because I and I'm I I'm I'm sorry if I hurt somebody because me so appeal is that so that we can cremate her. Number two, we have full faith in the CBI. Please fast track it. Please immediately get the CBI activated so that whatever Gundardi that you are seeing in this Japalur court and where the even forget about my family the the the reporters are being threatened, the reporters are being beaten, chairs being thrown on them.
Thank you. I want to cut across uh to Tarita Shankar Indra University owner Tuisha's professor Mihas Sud advocate supreme court scholar of women's right.
You know may I want to ask you allow me to ask you one question because what most people are not understanding is and one can you know hear it in the frustration of the family every time they speak because if it is a case of dowi harassment if it is a case of domestic violence in terms of dowi then the onus lies on the accused which is the family what one doesn't understand Mihira is how is it that girabala saying the mother-in-law had got anticipatory bail Because in all of this uh you know this is immediate arrest and I understand every time you speak to the father you speak to the brother because they they they just don't can't seem to uh you know uh put it in words on how frustrated they are. Usually the family should have been arrested immediately.
talking >> you know anticipatory bail is denied where even when there is far less evidence than this and in this case there is so much in terms of you know the kind of conversations she had recorded conversations text messages etc that she had with her friends and family um you know anticipatory bail is not given in cases with far less evidence so it is it is shocking that her anticipatory bail was denied and the constant claim that you know We are being hounded. And you know the idea that there is some persecution when in fact the law states that when a woman faces an unnatural death you know uh suffers an unnatural death within the first seven years of marriage it is presumed to be caused by dowry harassment and the onus is on the in-laws the husband and the in-laws.
Now it seems his lawyers uh are running are uh actually going to submit an application move an application before the chief judicial magistrate so as to allow Samur to surrender in Jabalpur itself.
All right let's I'll come back to you Anisha just one minute the reason I'm interrupting you is I want to cut across to Mr. Navnidhi Sharma he is Tuisha's father Sharma Gihad Shukria thank you. You're joining us right now taking the time out sir.
Honorable High Court only can surrender in front of IO or trial court.
What is this? But threatening situation against the law.
Look out.
He should be in the custody.
Honorable High Court.
The >> second postmortem has been allowed by the court. Are you >> has been allowed has been allowed and uh the panel will be finalized by the as director or with the director of the court uh high court. So we are waiting for that.
At the same time pri the question really goes to the police because this as and we've been discussing this this is a cognisible offense. This means that if the ACP of the area the SHO finds out that a person who is accused of this heinous crime is within their jurisdiction that they should then direct their officials to go and arrest him. The only place that Sam could not have been arrested was if he was actively inside the courtroom which he was not. He was roaming around in the court corridors. So clearly he could have been arrested.
