What makes this even more embarrassing is how dramatic the complaint sounds. saying they were ambushed creates the impression that they really really believed Brown Magazi was untouchable and innocent or somehow protected from consequences. Many viewers following the Madlanga Commission are stunned by the incompetence shown by this two teamu lawyers because instead of calming the situation, the legal team's comments have only intensified public criticism.
The situation has now become even more humiliating for Brown Magaz because the focus is no longer only on the arrest itself but also on the apparent shock and confusion coming from his own legal representatives in front of the entire country. this. So we are now joined by Brown Mhodsi's legal representative Radasi Saja and he joins us now via our telephone line and sir thank you so much for your time this evening here in SABC news and let's start off here how and when did this arrest take place?
>> Uh good evening and good evening to your listeners. Uh we are informed because we were not present at the time of the arrest that the arrest happened immediately after uh our client giving testimony at the commission and it happened outside the commission uh offices >> and this arrest we also understand that it's in connection to that case and matter that Brun Mutzi um did report to the Foseris police station saying that there was an attempt on his life.
>> Yes, the details are not that clear now, but the information that we have before us is that yes, it relates to a defeating of the the defeating the hands of justice case in for that. That's correct.
>> And we also understand that the there is uh questions here surrounding the firearm that was used in that incident.
So this is information that we received from the media as well. Uh we have not spoken to the police in relation to this particular matter and we do not recall anything about a firearm being recovered from our client in relation to that particular arrest. So even that we believe it just trumped up cases I mean trump clumped up charges which may have been motivated by our trans spend in relation to his evidence in the Madlanga commission.
>> And when it comes uh to Brown Mahooti have you spoken to him? Have you seen him? What did he say to you?
No, we have not yet spoken to him and we are intending to speak to him as soon as possible. Uh we are just more concerned about the fact that they arrested him and he's probably hungry wherever he is.
He's probably cold because as you can see that it's very cold now. So we are concentrating on making sure that we keep him warm. We are going to find something warm for him so that he can actually be be warm wherever he is.
>> Which police station has brazi been detained in and when can we expect him to appear in court?
>> Uh we do not have the details of the police station at this stage >> but we are in communication with the investigating officer in relation to the matter.
>> And when will he be appearing in court?
We are hearing from the police that he is expected to appear on Monday.
>> Yes, we you know in light of the 48 hours within which that he needs to appear, we expect that he should be appearing on Monday.
>> Uh uh it was around uh4 10 later then we heard a the the gunshot [music] then it came out immediately. Then when I come out immediately I saw the car the the lights are on. Everything was on. Even the car was uh running. The engine was running. Then we went there with my [music] We went there just we went there with my uh uh uh uh uh guys here. We used to to patrol together. Then we we didn't find no one here there in the car. When when when I come back when I come back I found brah mukoti he was on the way to us with a golf with a white golf then those guys for white golf they come and drop him there by the scene >> then I took him to where and stay there >> then he just keep the the ID I said guys I'm braz can you help me >> what did he explain to you about what exactly was happening when you found him Hey, >> uh he said uh there's a guy who's following him from uh Sprite View BP garage. Then I told him uh can I call the police? He said no don't call the police because those police I'm wanted by the police. I said who's going to who who may I call?
Whom may I call? He said no. Don't call the police. Then I call one of my guy that that we know you he used to work with a hijack car. Then I gave him the registration number for that car. Can you check this car if is hijacked? Is reported hijack hijacked?
Then the guy come back to me. He said, "No, that car is a company car.
>> Were you concerned at all at the fact that he didn't want you to to call the police and alert them to what was happening?"
>> No, you didn't.
>> Yeah, >> he didn't. Yeah.
>> You just say, "No, don't call the police." And my brother, you already called the police. And on that call I was in he just put he just put me in on the on the h call when they tried to call the police most of those police they were refused to come and said no braoti real braot I said yes is real brahoti is here I took my phone and sent the location for everyone to dispatch the location.

>> What kind of condition was he in? Was he shocked? just talk to me.
>> I was shaking like when when the when the light when the car when the uh the lights of the car arrived, you just run to the toilet just near nearby us here.
You just run inside there.

>> So to you did it look like a situation where anybody had been following you following him?
>> No, there was no there was no one following because the the lady who was next to him when he's busy shooting, she was even now she's traumatized. Yeah, >> she's traumatized even now because he was shooting that car facing his direct his direction for the for that lady direction.
>> We've heard allegations he hopped into a a car. Could you maybe confirm or deny this that his security personnel arrived quite quickly as well?
>> No, those guys they took uh almost everyone that I called they took almost 1 hour 1 hour couple minutes. There's no one who So all of them they were they were refusing to come to to to the scene.
>> Yes. Did he did he say where he was going?
>> Yeah. He said he's going uh you show this you show this at uh Don Park site but I I can't remember the the name want is to prepare a bail application. We're going to be making sure that we consult with our client, preparing a a bail affidavit so that we can actually prepare our case on Monday so that we can actually secure his release on what we're going to be doing.
>> Does your client maintain that he's innocent?
>> He maintains that he's innocent and even the constitution protects his innocence until proven guilt. And what what do you make of the case that he could have um possibly staged what we saw in Frost Lauras in November the second where he claimed that there was a so-called attempted hit on his on his life.
>> Like I've said, our client maintains his innocence and we believe that once those part that particular evidence is presented before our client, we will ensure that we're going to report uh each and every allegations which have been made that he actually sty Have you seen him? Have you spoken to him?
>> Look, uh we have not. We have briefly seen Mr. Miy and we are actually going to have a proper proper consult a brief consultation again so that we can actually speak to you.

The vehicle that Brown Mahi was traveling in were inside the phosphorus uh police station at the moment and it's parked right at the entrance of the what would be called the client service center really. So my colleague Tabu is giving you what looks like a shattered window but also some bullet holes really uh that are on this particular vehicle.
Um you know these are just visible uh from our standpoint really but I want to bring in uh Atlender Mat who give us a sense really of what uh really transpired at Linda thank you so much for your time um this is the vehicle that uh Brown Modi was traveling in.
Won't you just get give us a sense of what exactly happened? A very good morning and thank you for the opportunity. At around 10:00 last night, we were called by a security official uh belonging to a private security alerting us that there was a a shooting um around the area. We immediately dispatched a team of police officers and upon arrival we did find um the security official together with Mr. Brown Moti who alleges that there was a shooting h there were there was another car a baky a white baky he does not know the make um where those individuals started shooting at his um his vehicle while he was allegedly inside. So um we then encouraged him to open a case. He alleges that he was uh traumatized at the time. He did not feel safe. Um so he has promised us that at around um 8:00 this morning he will present himself to the false lores police station to open a a a a case formally but we have we are investigating a case of attempted murder for now um as the SAPS um we have seized the vehicle as you can see um at that time last night at around um when we got the report at around uh 10:00 we did dispatch a team of um forensic experts uh just to gather all physical evidence that will be able to assist us uh to solve this particular case and to assist us to determine what actually happened here. Um so we can confirm that our local uh criminal record center did attend to the scene. Our forensic experts, your fingerprint experts and so on, your ballistic experts, they did um attend to the scene and we are investigating a case of attempted murder. So for now um I'm told by the acting station commander that Mr. Browni did promise to um avail himself at the police station at around 8:00 to open a case so that we can formally take his statement. Um we are still waiting for him and we are hoping that he will uh present himself h because now it's past 8:00 and he has still not arrived.
>> Is it clear um in terms of where exactly he was going or coming from? Do you know those details?
>> Well, at this stage because we are still waiting for Mr. Brown Modesi. Um it's not yet clear where he was coming from and where he was going. So those are some of the details that we would like to um you know collect and gather from him uh so that we are able then to take down a a formal statement and investigate the case further. Obviously, because this was a shooting, one would expect that there are exhibits that may have been collected from the scene like bullet casings which will assist in really determining uh you know the the crime itself. Talk to us about some of those exhibits that were picked up from the scene which will give police really an idea of what exactly happened here.
>> Look, obviously we wouldn't want to educate criminals on how we conduct our investigation. So all I can confirm is that we have gathered all physical evidence material that was at the scene that will assist us to solve this case and that evidence will be able to give us um you know an idea of what really transpired. So our teams are working around the clock uh to try and solve this particular case. But what is important and what will assist us is to get Mr. Brown Modes's statement. So we are waiting for him h here at the forlas police station.
>> We understand that sorry just one last one. Do we understand that he was traveling with someone else? Um this would mean that there are no injuries right since he's able to to present himself uh to the police station. But do we also know the identity of the other person? So for now we are told it's not yet clear but we are told he was alone >> um or he might have been with another individual. So those are some of the facts that we need to verify. Was Mr. Brown Modi alone? Was he traveling with another individual? Who is that particular individual because we would have to get the statement a witness statement from that individual and and and and so on. So we are hoping that um he will present um himself at the police station so that we are able then to conduct a thorough investigation to get to the bottom of what has happened. Um but our investigations continue. Um the car is here at uh the police station. It is safeguarded and um we we are on the ground and we are hard at work to solve this particular case and to actually determine what exactly happened last last night. Atheinda, when we look at the state of the vehicle, it doesn't seem to be a car that was uh, you know, upkept or regularly used. Just talk to us in terms of the registration. Do we know who the car belongs to?
>> Yes, we have already ascertained and determined who the car belongs to, but that's for police investigations. We do know who the h car belongs to.
>> But does it belong to Brow?
>> Well, I can't confirm that for now. We know who the car belongs to. It has been circulated and that is for our investigators then to investigate further as to where this car was coming from and where it was going.
>> Do you suspect any foul play here?
>> Well, we are still investigating. We are investigating a case of um attempted murder and I will leave it at that.
>> All right. That is Athena Mate Arab talking to us about uh you know the events that happened last night. It's clearly uh very sketchy at the moment and there are no really tangible details, but uh you would have heard that question about the upkeep of the vehicle. And I just want to draw your attention. I mean, if you look at the vehicle and the tires and just how worn out they are, which really brings about a question around whether or not this vehicle was used regularly and [snorts] really the upkeep of this particular vehicle. Well, I just also want to bring you um to to to the side. I mean, you look at the condition of the vehicle itself, and I know Atlenda says it's not yet clear really uh what could have possibly transpired, but just from a naked eye, um you know, with really no expertise into criminal investigations or even uh crime scene investigations, one would look at this vehicle and try to really establish whether or not um you know uh there was any other person in this particular vehicle or not. And this is one of the things that they are trying uh to establish were warned really not to touch anything. But also if you look at uh this side and the state of of the tires from this particular angle, you know, one wonders uh who number one this vehicle belongs to and whether or not it was used on a regular basis. It seems at this point that police really do know who the owner of the vehicle is and they don't want to tell us uh or even confirm that this vehicle belongs to Brown Mort.
And I was asking that specific question around some of the exhibits that were collected from the scene because if you look at the windscreen there, I mean I'm not, you know, a forensics expert or a ballistics expert, but I, you know, looking at that, I wondered in my head, what object would that be that would uh, you know, cause such damage?
Could it be a bullet or could it have been something else? But uh you know the police are saying they're investigating trying to really establish the circumstances around this shooting.
There was another vehicle. According to the preliminary information that the police have and have received, there was another vehicle. Um it's a van. He couldn't tell what kind of make it is.
And uh you know that's when the shooting happened in the vicinity of Fossler which basically is the jurisdiction of this police station. So uh this vehicle has been seized and will be part of the ongoing investigations to determine what exactly um you know happened. There is uh what seems to also be, you know, a box of whatever meal that was perhaps being had in the vehicle.
But of course, we're only limited to where we're standing. So, we are not allowed to touch anything because of course it's still a matter that is under investigation. So at a later stage then we're hoping that Brown Makoto will present himself because according to the police he indicated that uh he would come at around 8:00 to give a full statement uh you know about what exactly happened here. So the police the acting station commander um has told um Atlender Mate who is the SAPS spokesperson that he promised that around 8:00 he will come and give a statement.
